travel documents

It is your responsibility to have valid travel documents. If we, or your carrier, are fined as a result of you holding incorrect documents we will ask you to pay this amount.

problems or complaints

In the unlikely event that you have reason to complain or experience any difficulties with your holiday whilst in Sicily, you must bring the matter to the attention of the Open Sicily representative/agent and the relevant supplier immediately, as this is an E.C. requirement. Verbal notification must be put in writing and given to our representative as quickly as possible. Open Sicily has local representatives in Sicily in order to provide you with assistance. However, if we are unaware of a problem or complaint then we are unable to assist with resolving it. If you are still dissatisfied, you must then write to us within 28 days of your return to the UK, quoting your booking reference number and providing full details of your complaint. Upon receipt of your letter we will acknowledge it, investigate the points raised and reply within 28 days or, if this is not possible, send you an interim letter advising of our progress. We cannot accept liability in the event that you fail to notify us of the complaint or claim in accordance with this clause.

jurisdiction

This contract is governed by the law of England and Wales and exclusive jurisdiction is conferred on the English and Welsh Courts .No employee or representative of this company has the authority orally to vary these terms and conditions or the information within this brochure, or company literature or to enter into verbal agreements with customers of this company.

severability

If any terms, or provisions of these terms and conditions are determined to be unlawful, invalid, void or for any reason unenforceable, the validity of the remaining terms, conditions and provisions shall not in any way be affected or impaired thereby.

data protection policy

It is necessary for us to acquire information from you in order to process your booking. We take full responsibility to ensure that your information is protected. We must pass your information on to relevant suppliers such as airlines, property owners, hotels, transport companies etc. Also, Security companies, public authorities such as customs/immigration must be provided with your information in accordance to their request or by law. Your information will be held so that we can inform you of our future service offerings. If you do not wish to hear from us with future offers or wish to obtain a copy of the information, held on file, please contact us.

entire agreement

This agreement and the documents referred to in it, constitute the entire agreement and understanding of the parties and supersede any previous agreement between the parties relating to the subject matter of this agreement.
